Man Sues Spirit Airlines Claiming Flight Attendant Sexually Assaulted Him

A man has filed a federal complaint against Spirit Airlines, alleging sexual assault by a flight attendant on a flight from Myrtle Beach, California to Philadelphia.

After leading the victim to the back of the plane and plying him with booze, the flight attendant is said to have groped the victim’s penis before attempting to unzip his pants.

According to a lawsuit filed on behalf of the victim in Pennsylvania Eastern District Court this week, the incident occurred on June 30, 2021. According to the victim’s lawyers, a criminal complaint has already been filed with local police and the FBI.

The Atlanta man claims he was sitting in row 26 near the back of the plane when a male flight attendant approached him and asked if he wanted any water.

The flight attendant waived the normal cost when the victim, who has only been identified as M.B. to protect his identity, received the water.

The flight attendant allegedly reappeared a little time later, winking at M.B. and thrusting some mini bottles of Jack Daniels at his breast. The sufferer didn’t think much of it at the time, but the flight attendant returned soon after and offered him more Jack Daniels.

On the third pass, the flight attendant handed the victim a balled-up napkin that disclosed a phone number when unfolded.

The flight attendant is said to have approached the victim as the plane approached Philadelphia and urged him to accompany him to the back of the plane. M.B. claims that due to the flight attendants’ position of authority in the air, he felt compelled to join them.

The flight attendant “looked around and then, without warning, grabbed, groped and fondled” the victim’s penis before attempting to unzip his pants once they were in the back galley.

The victim claims that he felt violated and that the flight attendant’s actions surprised and embarrassed him. Before returning to his seat, he went to the restroom to collect himself.

He wanted to report the assault, but he didn’t know the name of the flight attendant. The victim claims he had a text chat with the flight attendant after obtaining the flight attendant’s phone number, in which the person on the other end asked him what he was doing after the flight.

The second part is said to have apologized to the victim and stated that he “didn’t mean to be impolite.”

The incident was reported to airport police and the FBI by the victim.

Spirit Airlines “knew or should have known about the sexual assault being committed by its employee” as well as his “propensities to sexual violence, physical violence, and sexual deviance,” according to the lawsuit.

The airline has been charged with negligence, while the unidentified flight attendant has been charged with battery and assault. The victim is suing the defendants for at least $150,000 in damages.
